This website is built with Google Sites and hosted by Google which is totally free for any Google account as long as everything fits in 15GB. Our only cost is the yearly domain name renewal. It's rudimentary to be sure, but seems to be useable on any common screen size. The site is publicly available, but is setup not to be indexed by search engines. The goal is to avoid any confusion with official Bay Breeze at MiraBay sites.
The Bay Breeze Declaration states: The names "Bay Breeze" and "MiraBay", along with all logos associated with such names, are the proprietary trade names and/or service marks of the Declarant or Declarant Affiliates.
The name Bay Breeze is a rather common name used commercially by multiple companies across the US. In Florida, Trademark is used to identify a tangible product and a Service Mark is used for services. Both must be registered with the the Florida Department of State. In the Tampa area companies registered to use Bay Breeze in their name include Bay Breeze Condominiums and multiple Bay Breeze Carwashes.
The Bay Breeze Declaration states:
the Association may use the words "Bay Breeze" and "MiraBay" in its name
Owners may use the name "Bay Breeze at MiraBay" where such term is used solely to specify that particular property is located within the Community
There has been no effort by the Declarant to register or enforce Bay Breeze as a Trade Name, Trademark, or Service Mark. The Bay Breeze owners are explicitly entitled to use Bay Breeze to identify our neighborhood and the HOA also has the right to use the name. So as long as there is no attempted deception, there should be no concerns about fair use of the rather common name Bay Breeze.
* Bay Breeze Cottages— Builders Cardel Homes and K. Hovnanian Homes are building models that will be featured as Showcase Homes in this year’s Tampa Bay Builders Association Parade of Homes from April 17-May 2. The 1- and 2-story home designs, created just for MiraBay, range from 1500 to 2600 square feet and feature front porches and alley-entrance garages. All cottages are low-maintenance (with a separate HOA managing landscaping and water) and are built to Florida Green Building Coalition standards. Cardel and K. * As some long-term MiraBay residents may know, Bay Breeze was originally planned as attached villa homes, similar to the Seacrest neighborhood. As a result of home shopper input requesting low-maintenance, single family detached homes, however, Newland modified the existing developed lots from attached homes to detached homes in 2009. The lot sizes and land plan for Bay Breeze remained as was originally planned for this neighborhood.
* The Bay Breeze landscaping plan is designed to complement the existing lush MiraBay landscaping palette, while making the most of the adjacent Wolf Branch Creek preserve. A shell trail, accessible to all residents, will be built in phases as construction progresses along the preserve.
* Construction will begin on Wolf Creek Park later this spring; the park is located on Manns Harbor Drive and will be accessible to all residents.
* A temporary construction entrance will be built to provide construction traffic access via Villamaire Road within the next 90 days.
