The turnover Transition Meeting of Membership was Sept 23, 2021. A new resident controlled board was seated and has control of the HOA.
Turnover is when the developer 'turns over' control of the HOA to the residents. We have been planning for the transfer of power. We will always need more residents willing to take on roles in our association.
The Class B Control Period has ended, so the Declarant can no longer amend our Declaration. The Development and Sale Period ended March 8, 2022 when the last Bay Breeze home was sold.
Perhaps the most critical time period in the entire existence of the association is when control passes from the developer to the unit owners. This is commonly referred to as “turnover.”
The turnover process is important because for the first time, the unit owners are totally in control of the association and their own destiny. Even more important, however, is the fact that upon turnover, important deadlines begin to run regarding the association’s rights to pursue potential claims against the developer.
The Board of Directors comprised solely of the unit owners has an awesome responsibility. It is their job to ensure that the developer delivered all that was promised and that the physical property and the association’s finances were properly maintained during the time period the developer was in control of the association.
Florida law governs the transition of association control from developer to owners. Some turnovers are smooth and accomplished in an expeditious manner. Other turnovers are difficult, complex, and result in litigation.
